These Terms of Service (“Terms”) govern your use of the services provided by Websterz Web Solution (“Websterz Web Solution,” “we,” “us,” or “our”), including domain registration, web hosting, dedicated servers, virtual private servers, web design & development, search engine optimization, server management, and all other related services such as cloud hosting, control panels etc (collectively referred to as the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

1. Account Setup and Usage

1.1. Account Creation: To access and use our Services, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and ensuring that only authorized individuals have access to your account.

1.2. Acceptable Use: You agree to use our Services in compliance with applicable laws, regulations, and these Terms. You shall not use our Services to engage in any illegal, abusive, or unauthorized activities, including but not limited to spamming, distributing malware, or infringing intellectual property rights.

2. Products & Services

2.1. Web Hosting Accounts (All packages):
  • CPU intensive files are not permitted on our servers and accounts may not to be used to host a collection of mp3s, audios, videos, anime, .rar files, Warez, gamers sites, shout cast and similar, or to backup your computer or another source.
  • They may not be used for general storage of any type. They may not be used as download mirrors or download/upload portals.
  • While the sale of eBooks and other legal small download files are permitted within reason with the unlimited package, hosting and storage of mass quantities where our servers are used as a distribution point is NOT PERMITTED
  • They MAY NOT be used for HYIP (High Yield Investment Programs), Ponzi schemes or pyramid schemes. They may not be used to provide proxy servers.
  • These accounts may not be used as a download distribution point for your software or media.
  • They are to be used for standard web practices only. This means that all content stored on a shared account must be used for “acceptable” website use.
  • “Unacceptable” usage is anything that a shared server would not be able to provide under standard circumstances and uses a high percentage of CPU or Memory (5%) usage.
  • On “Unlimited Hosting Package” you can add 50 subdomains, 50 mysql databases, 50 emails accounts, if you need more than these limits you need to provide justifications for usage.
  • Sharing copyrighted streaming links or embedding code is STRICTLY PROHIBITED on shared hosting accounts and may cause suspension of account, however it is not applicable on DMCA-Free hosting.
  • Nulled, Cracked, Illegal and copyrighted contents/scripts are STRICTLY PROHIBITED on all web hosting packages.

2.2. Resource Usage limits For DirectAdmin Shared Accounts:

  • 20 concurrent connections (Realtime)
  • 1,00,000 inodes (Hosted Files)
  • 2GB Physical Memory
  • 20MB Input/Output
  • 400% CPU Speed
  • 15 emails sending per hour

2.3. Resource Usage Limits for:

Corporate Web Hosting Plan

  • 100 concurrent connections (Realtime)
  • 200,000 inodes (Hosted files)
  • 1GB Physical Memory
  • 10MB Input/Output
  • 100 Emails sending per hour

Dedicated Web Hosting Plan

  • 200 concurrent connections (Realtime)
  • 400,000 inodes (Hosted files)
  • 2GB Physical Memory
  • 20MB Input/Output
  • 100 Emails sending per hour

2.4. cPanel, DirectAdmin Reseller & Master Reseller:

  • Remember that if you re-sell hosting on our servers you are responsible for what your clients do. It is your responsibility to monitor your clients to ensure that you enforce our TOS. If your clients are found repeatedly breaking our TOS that result in illegal activities, or server downtime, that this will put your account in jeopardy.
  • If client’s account is hosted under reseller account and wants to move/transfer his account to other reseller (hosted with us), we will ask a reseller currently hosting that account to approve the transfer/move request. If current reseller has payment or any other issue with the account holder, in that case reseller has right to reject the request.
  • If current reseller does not respond within 72 hours. We will consider the request approved and will move/transfer the account under new reseller ownership.
  • All of cPanel, DirectAdmin, Web Hosting TOS are applicable for DirectAdmin and cPanel Resellers as well.

2.5. Virtual Private Servers (VPS) & Windows RDP Servers:

  • If a VPS generates too much load on the node this may cause suspension of VPS to prevent effect on other VPS hosted on the same node.
  • Windows VPS (RDP) servers come with Trial license of Windows Server Standard Editions. Trial license is activated for 180 days and can be renewed for maximum 360 days.
  • Trial license can be converted to standard license after 360 days, you can use your own keys or we can also activate your Windows server license with additional charges.
  • Windows license is included free if you purchase on annual basis.
  • Our Windows license does not support re-installation of the operating system it can be activated only once, however your own license can be re-activated if supported.
  • Any OS/Distribution that is not available within our templates, we shall arrange it if applicable.

2.6. Dedicated Servers (All Locations):

  • Dedicated servers are provisioned upon successful receipt of the payment.
  • All type of contents are allowed on Dedicated Servers as long as they’re legal and do not belong to intellectual property, we forward the notices i.e DMCA notices to you, so you will deal them at your own.
  • You shall respond to the abuse complaint or notice within the timeframe stated in the notice.
  • Websterz Web Solution shall not take any responsibility of the information provided in the notice or abuse complaint.

2.7. IP Address Allocation:

We have multiple blocks of IPv4 addresses allocated from the ISP. IP blocks are allocated randomly and cannot be changed unless valid reason is not provided. There are following reason or circumstances IPs can be replaced/changed:

  • If IP block is not reachable.
  • If IP block is blacklisted on Realtime blacklist, DNSBL or RBL
  • If IP block has other connectivity/network related issue
  • If you have any of above issue with newly delivered IP block you should report it and ask for replacement within 24 hours of the server delivery. After 24 hours we shall not be able to replace it.

2.8. rDNS Update:

  • Reverse DNS (rDNS) are updated once per month per IP, this is applicable for all dedicated servers, vps, hosting accounts and reseller accounts.

2.9. Domain Transfer During Auto Renew Period

A domain name is transferred sometime before its Expiry, in order to renew it with the Gaining Registrar. This results in one year getting added to the domain name’s Expiry Date. The charges for this one year are collected by the Gaining Registrar. There is, however, a case when it seems as if this one year is not added during the Transfer process. 

if a domain name expires, it is not deleted immediately. The Registrar of the domain name must explicitly delete the name within 45 days or else it is deemed to have been renewed. This period of 45 days is called the Auto Renew Period.

If during these 45 days, the Registrant renews the domain name with the Losing Registrar and then transfers the name to the Gaining Registrar, then the domain name will lose the year that was added with the Losing Registrar while renewing the domain name. 3. Resource Usage

  • Including but not limited to employing applications which consume excessive CPU time, memory or storage space.
  • Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances.
  • Streaming media, audio, video and shout cast can be a drain on web server resources and as such is not allowed.
  • CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP message forum.
  • The use of web cam applications which maintain a constant FTP connection uploading an image at regular intervals is forbidden.
  • Shared and reseller hosting customers are not permitted to provide a free web site hosting service such as image hosting, file hosting, mp3 hosting and any similar hosting service.

4. Spam & Bulk Marketing

  • Spamming (sending unsolicited email or posting messages to irrelevant UsetNet newsgroups that do not explicitly allow advertising, with references to a site hosted on our servers) is STRICTLY PROHIBITED.
  • Sending bulk emails, marketing emails, or maintaining mailing lists is STRICTLY PROHIBITED.
  • ZERO-TOLERANCE-SPAM-POLICY: Websterz Web Solution has zero tolerance for UBE/UCE (unsolicited bulk email/unsolicited commercial email). This policy protects our customers as well as the internet community from the negative effects of “spam” related activity. If you cause any of Websterz Web Solution IP to be listed in spamhaus, your service will immediately be terminated and you will not be able to place any additional service order from Websterz Web Solution.
  • Our anti spam system automatically detects and null route IPs upon the outgoing spam or suspicous activity. It null route IPs atan 1st for 10 minutes, after 1st null route if suspicious activity continues, it again null route IPs for 30 mins then 24 hours and then for 7 days.

5. Undesirable Content

  • We do not host pornographic content of any description.
  • We reserve the right to determine what constitutes pornographic content and what does not. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden.
  • In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, or trafficking in obscene material.
  • The sale of resellable eBooks is ok.
  • Pornography, illegal, copyrighted, pirated, sexual, spamming, bulk emailing, nulled scripts, wares linking and any kind of illegal contents are NOT ALLOWED and STRICTLY PROHIBITED, and may cause immediate suspension of services.
  • All type of contents are allowed on Dedicated Servers as long as they’re legal and do not belong to intellectual property, we forward the notices i.e DMCA notices to you, so you will deal them at your own.

6. Backup Policy

6.1. cPanel, DirectAdmin Shared Hosting, Resellers: Although monthly back-ups are performed, Websterz Web Solution shall not be held responsible for any loss of data. It is up to the hosting account owner to ensure you maintain a local copy of your web data for your own back-up purposes.

6.2. Automated Backups: Automated monthly backups are performed to ensure no data loss during the natural disasters or in the event of hard disk failure, if you or your client has accidently deleted/terminated account and wish to restore it from the last available backups, you will be charged accordingly for this restoration. However backup availability is not guaranteed!

6.3. Retention: You can keep only one backup at a time in your individual account only for 3 DAYS, we will delete your backup which is older than 3 days. It is your duty to download the backup file within 3 days to avoid the data lose.

6.4. File Types: Hence our servers are hosting servers not backup servers, therefore we do not allow hosting of backup files such as zip, rar, or any other compressed files. We instantly delete these files if found without any notification.

6.5. Dedicated Servers, Linux, Windows RDP VPS (All Locations): There are no backups performed for Dedicated Servers and VPS servers, you have to take backups at your own.

7. Refund & Cancellation Policy

7.1. Domain Registration: Domain registration/renewal/transfer fees are non-refundable once the registration/renewal/transfer process has been initiated. If user registers any domain name as part of a “Free Domain Name” promotion in connection with the registration, Subscriber’s refund will be reduced by our price for registration per domain name. Subscriber will retain full ownership and control of any such domain names.

7.2. cPanel, DirectAdmin, Resellers Web Hosting: We offer a refund within a specified period (typically 30 days if billed annually and 5 days if billed monthly) from the initial service activation or project commencement, subject to the terms and conditions outlined in our refund policy. After the specified period, refunds are not provided unless explicitly stated in a separate agreement.

7.3. Dedicated Servers: Dedicated servers fees are not refundable once order is processed, we usually process the order within minutes. 

7.4. Linux KVM/Windows RPD VPS: We offer a refund within a specified period, typically it is 5 days from the initial service activation or project commencement.

7.5. Web Design & Development, Digital Marketing, SEO, Website Speed Optimization: Web Design & Development, Digital Marketing, SEO, Website Speed Optimization and all other services that are not listed above are non-refundable.

7.6. Licenses, Management, Installation, IPs: Licenses, Management, Installation, IPs, Administrative fee and custom software are non-refundable.

7.7. Suspension, Termination: If your account got suspended or terminated due to violation of our terms of service, the refund will not be applicable in that case. We reserved the right to suspend/terminate an account which is found violating our terms of service.

7.8. Service Cancellation: We DO NOT refund partial cost of services. We require a 7-days notification prior to an invoice’s due date for cancelling a service. No refund can be issued for incomplete billing cycles, even if a cancellation request is issued prior to the 7-days period. Following the 7-days period, the previously generated invoice will have to be paid before issuing a cancellation request. The service will then be cancelled on the following due date. If failed to request cancellation before 7 days, disconnection fee will be applicable according to the service charges.

8. Delivery Policy

8.1. Delivery Method: All services are delivered digitally on email address provided during the registration.

8.2. cPanel, DirectAdmin, Reseller, Web hosting, Domains, VPS, Dedicated Servers: Delivery time for web hosting accounts, domain registrations, virtual private servers (VPS) and dedicated servers is 24 hours to 72 hours depending upon the availability in stock. This include business days only and not the weekends. We strive to meet the agreed-upon timelines, but any delays caused by factors beyond our control may result in adjusted delivery schedules.

8.3. Web Design & Development, Graphic Designing, SEO, Website Speed and all other services not listed: The delivery timeline for these services will be communicated to you during the order or project confirmation process. 

9. Payment Policy

9.1. Fees and Payments: You agree to pay all applicable fees for the Services as specified in the pricing and payment terms provided to you. Payments are due as per the agreed billing cycle, and failure to make timely payments may result in suspension or termination of services.

9.2. Automatic Renewal: Some Services may be subject to automatic renewal unless you cancel or request termination in accordance with our cancellation policy. You are responsible for maintaining accurate billing information to ensure uninterrupted services.

9.3. Prices: Prices are subject to be changed anytime without any notification or with notification, we are not bound to keep our prices and fees same as the international currency rate varies from time to time.

10. Support

  • We provide 24/7 support to our customers for billing/sales and technical issues via SUPPORT TICKET SYSTEM and dedicated support via WhatsApp (If purchased).
  • Our response time is 1 hour to 24 hours depending upon the current queue, however our response time is less than 30 minutes in some cases but is not guaranteed.
  • Dedicated support is not included with any of the advertised services, however you can contact us to purchase dedicated support for your services.

11. Termination

11.1. Termination by You: You may terminate your Services by following the instructions provided or by contacting our customer support team. Termination may be subject to applicable cancellation fees or refund policies.

11.2. Termination by Websterz Web Solution: We reserve the right to suspend or terminate your Services if you violate these Terms or engage in any prohibited activities. We may also terminate Services if required by law or for operational reasons. In such cases, we will provide notice unless immediate termination is necessary for security or legal reasons.

12. Violation & Penalties

  • Accounts found violating the terms of services and policies will be suspended/terminated without any notifications.
  • If any illegal contents are found, account will be suspended immediately without any warning, and you will be penalized from $10 to $3000 depending upon product/service.

13. Modifications to Services and Terms

We may modify, suspend, or discontinue any part of the Services at any time without prior notice. We reserve the right to update or modify these Terms at any time, and the updated version will be effective upon posting on our website. Your continued use of the Services after any changes constitutes acceptance of the modified Terms.

14. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use or inability to use our Services, including any damages resulting from data loss, service interruptions, or unauthorized access to your data or accounts.

15. Acceptable Use Policy

  • The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.
  • Our acceptable use policy is actively and strictly enforced.
  • Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Common sense is the best guide as to what is considered acceptable use.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising out of or relating to these Terms or the Services shall be exclusively resolved in the courts of Pakistan.
